The report exposes British American Tobacco Kenya’s (BATK) interference in implementing Graphic Health Warnings (GHWs) on nicotine pouches. BATK used legal loopholes, lobbying, media influence, and economic blackmail to delay compliance with Kenya’s Tobacco Control Act (TCA) 2007 and the WHO Framework Convention on Tobacco Control (FCTC).

Despite court rulings, BATK misclassified nicotine pouches, pressured government officials, and sought regulatory exemptions, especially by leveraging a Ksh 2.5 billion factory investment to weaken enforcement. The report calls for strict regulation, reduced industry influence, public education, and stronger enforcement to protect public health.
